Privacy Policy Overview

Thank you for visiting the website of Charlie’s Enterprises, Inc. doing business as OK Produce (“OK Produce”). This website is owned and operated by OK Produce, Inc. located at 1888 S. East Ave., Fresno, CA 93721.  This website (our “Website” or “Site”) is designed to familiarize you with the services of OK Produce (collectively, “us”, “we”, or “OK Produce”).  We respect your privacy and are committed to protecting it through our compliance with this Privacy Policy (the “Policy”).

OK Produce provides this Privacy Policy to inform you of our policies and procedures regarding the collection, use, protection, and disclosure of personal information received from your use of this Site, as well as all related websites including our subdomains, applications, browser extensions, and other services provided by us (collectively, together with the Site, our “Service”), and in connection with our customer, vendor, and partner relationships.

1. Personal Information Collected

We adopt this Policy to comply with the California Consumer Privacy Act of 2018 (“CCPA”). This Policy applies only to “personal information”, as defined in the CCPA, that we collect as a “business” as defined in the CCPA, but does not apply to personal information excluded from the scope of the CCPA. While CCPA applies to California residents, we believe everyone should have the same privacy rights regardless of where you live. With the exception of Sections 12 and 13, this Policy applies to all of our users. 

This Section 1 does not apply to employment-related personal information collected from California-based employees, job applicants, contractors, or similar individuals. To find this information regarding employment-related personal information, please see Section 5 below.

2. Purpose of Using Your Information

We may use or disclose the personal information we collect for one or more of the following business purposes:

  • To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to ask a question about our services on our Site, we will use that personal information to respond to your inquiry. If you provide your personal information to purchase a product or service, we will use that information to process your payment and facilitate delivery. We may also save your information to facilitate new service and purchase orders.

OK Produce will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

3. How We Obtain Information

We collect several types of information from and about you through the following sources:

A. Information Voluntarily Provided to us

  • When filling out forms on our Site (including without limitation, name, mailing address, email address, and telephone number).
  • Information you submit when you enter a contest or promotion sponsored by us.
  • Information you submit when you report a problem with our Site.
  • Records and copies of your correspondence (including email addresses and attachments to those e-mails), if you contact us.

Companies we work with to help us provide services or operate our business, including, but not limited to, website services, IT and software services, mailing services, billing services, cyber security services and office security services.

C. Personal Information Automatically Obtained by Use of Service

As you navigate through and interact with our Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Website, including traffic data, location data, and other communication data and the resources that you access and use on the Website.
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

4. How We Share Your Information

We may disclose for business purposes some or all of the categories of personal information described above with the following categories of third parties:

Service Providers: We engage certain trusted third parties to perform functions and provide services to us, including hosting and maintenance, error monitoring, debugging, performance monitoring, billing, customer relationship, database storage and management, and direct marketing campaigns. We may share your personal information with these third parties, but only to the extent necessary to perform these business functions and provide such services. We also require these third parties to act reasonably to maintain the privacy and security of the personal information they process on our behalf.

Compliance with Laws and Law Enforcement: OK Produce cooperates with government and law enforcement officials or private parties to enforce and comply with the law. To the extent permitted under applicable law, we may disclose any information about you to government or law enforcement officials or private parties as we believe is necessary or appropriate to investigate, respond to, and defend against claims, for legal process (including subpoenas), to protect the property and rights of OK Produce or a third party, to protect OK Produce against liability, for the safety of the public or any person, to prevent or stop any illegal, unethical, fraudulent, abusive, or legally actionable activity, to protect the security or integrity of the Service and any equipment used to make the Service available, or to comply with the law.

Corporate Transactions: Parties to transactions and potential transactions for the sale, transfer or licensing of a portion or all of our business or assets, including your personal information, such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution.

Professional Advisors: Professional advisors such as our lawyers, accountants, bankers and other outside professional advisors in the course of the services they provide to us.

Other Third Parties: We may share personal information with our administrative office, sales offices, and business partners to whom it is reasonably necessary or desirable for us to disclose your personal information for the purposes described in this Policy.

No “Sale” of Personal Information: OK Produce does not “sell” your personal information as defined in the CCPA.

5. Personal Information For Job Candidates

Pursuant to the California Consumer Privacy Act, this Notice pertains only to personal information OK Produce may have collected about a California resident in the course of such person acting as a job applicant to, an employee of, director of, officer of, or contractor of OK Produce. During the course of your application for employment with OK Produce, we may collect certain information about you. The categories of information we may collect, and the purposes for collecting them, include:

6. How We Protect Your Information

The security of your personal information is important to us and OK Produce uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information consistent with industry standards. Please remember, however, that no method of transmission over the Internet or method of electronic storage is 100% secure.  While we strive to use commercially reasonable means to protect your personal information, we cannot ensure or warrant the absolute security of any information you transmit to OK Produce or the Site, and you do so at your own risk.  Once we receive your transmission of information, OK Produce makes commercially reasonable efforts to ensure the security of our systems. Of course, no method of Internet transmission or data storage can provide guaranteed protection to your information. In the event that personal information is compromised as a result of a breach of security, OK Produce will promptly notify those persons whose personal information has been compromised, in accordance with the notification procedures set forth in this Policy, or as otherwise required by applicable law.

7. Do not Track

Currently, various browsers — including Microsoft Edge, Google Chrome, Firefox, and Safari — offer a “do not track” or “DNT” option that relies on a technology known as a DNT header, which sends a signal to websites’ visited by the user about the user’s browser DNT preference setting. OK Produce does not currently commit to responding to browsers’ DNT signals with respect to the Site, in part, because no common industry standard for DNT has been adopted by industry groups, technology companies or regulators, including no consistent standard of interpreting user intent.

Our Site contains links to other websites. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party. 9. Notification Procedures

It is our policy to provide notifications, whether such notifications are required by law or are for marketing or other business-related purposes, to you via email notice, written or hard copy notice, or through conspicuous posting of such notice on our Site page, as determined by OK Produce in its sole discretion.  By providing OK Produce your email address, you consent to our use of your email address to send you Site and service-related notices, including any notices required by law, in lieu of communication by postal mail provided that we reserve the right to determine the form and means of providing notifications to you, provided that you may opt out of certain means of notification as described in this Policy.

10. Minors

OK Produce and its Services are intended for an audience over the age of 18. We don’t knowingly collect personal information from children under 16. Because we don’t knowingly collect this information, OK Produce also does not sell personal information of minors under 16 years of age. If we find out that a child under 13 has given us personal information, we will take steps to delete that information. If you believe that a child under the age of 16 has given us personal information, please contact us through the Contact Us section on the Site.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

Exercising Access, Data Portability, and Deletion Rights

You may only make a request for access or data portability twice within a 12-month period. The request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. We reserve the right to confirm your California residency. Government identification may be required.
  • If you wish to designate an authorized agent to make a request on your behalf, we will need to verify both your and your agent’s identities, which may require submission of government identification. Your agent must also provide other proof of authority acceptable to us in our sole discretion.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
  • We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. In certain cases, we may be permitted by law to deny your request.

Making a request does not require you to create an account with us. We will only use personal information provided in a request to verify the requestor’s identity or authority to make the request.

13. Non-Discrimination (California Residents Only)

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
